Mark Lambert, Partner

Mark Lambert is a partner in the Cooley Litigation department and a member of the Intellectual Property practice group. He joined the Firm in 2009 and is resident in the Palo Alto office.

Mr. Lambert specializes in the representation of technology companies in a diverse range of disputes involving intellectual property. He has trial experience in cases involving trade secrets, copyright, patents, IP licensing and unfair competition disputes for clients in a wide range of technologies and industries. Mr. Lambert also uses his litigation experience and industry expertise to advise companies on how to avoid disputes and reduce litigation risk.

Mr. Lambert's most recent accomplishments include the following:

  • Obtained a preliminary injunction affecting two target product lines on behalf of a technology licensor. The product lines in question represented a significant threat to the effectiveness of standardized encryption technology that facilitates uniform rules for DVD playback technologies and the availability of copyrighted content distributed on DVDs.
  • Obtained summary disposition in favor of his client against copyright and trade dress claims, in which the plaintiff was seeking an injunction directed at financial services software and damages in excess of $10 million.

Mr. Lambert has published and publicly presented on a range of topics including new developments in Internet Service Provider liability, remedies provisions in technology licenses, and legislative reform and new developments in approaches to patent damages.

Mr. Lambert earned is J.D. in 1998 from the University of California, Hastings College of the Law. While at Hastings, he served as an executive editor of The Hastings International and Comparative Law Review, and as extern to the Honorable A. James Robertson, II of the Superior Court for the City and County of San Francisco. Prior to law school, Mr. Lambert taught high school English Literature at St. Mark's School of Texas.

Mr. Lambert is a member of the California State Bar, and is admitted to the U.S. Court of Appeals for the Ninth Circuit, U.S. District Court for the Eastern District of Texas, and the U.S. District Courts for the Central, Northern, and Southern Districts of California.
