Patrick Gunn, Partner In Charge - SF

Patrick Gunn is Partner-in-Charge of Cooley's San Francisco office and co-chairs the firm's Real Estate Litigation Group. He joined Cooley in 2000 and his practice focuses on complex business and real estate litigation.

Mr. Gunn has been named by Benchmark Litigation as a top litigator in California and has been repeatedly listed as a California "Super Lawyer", a designation reserved for the top 5% of attorneys in California, as determined by peers.

Mr. Gunn is active in the San Francisco Planning and Urban Research Association (SPUR) and is a member of the Urban Land Institute. Since 2004, Mr. Gunn has also served on the Institutional Review Board of The RAND Corporation, an international think tank devoted to improving public policy and decision making through research and analysis.

Mr. Gunn received his J.D. in 1994 from Boston University School of Law. In 1990, he earned a B.A. in International Affairs from the University of Colorado, where he was elected to Phi Beta Kappa and was an honors program scholar.

Representative matters currently or recently handled by Mr. Gunn include the following:

  • Acting as lead trial counsel in the defense of a real estate syndicator in 24 coordinated securities fraud actions alleging $260 million in losses.
  • Representing purchaser of 1500-acre property in suit against seller for breach of warranty and fraud.
  • Defending one of two members of partnership in action for dissolution and partition in kind of 700 acres of real property near Lake Tahoe.
  • Won a multimillion arbitration award for client defrauded in purchase of a California estate property.
  • Won an arbitration award defeating developer's claim for a $40 million fee allegedly owed upon cancellation of the development of a $1.5 billion headquarters facility in Silicon Valley.
  • Obtained dismissal of a $10 million slander of title claim arising out of a leading internet company's efforts to develop a new pedestrian campus in San Jose.
  • Defeated efforts by a commercial landlord to obtain a $22.5 million writ of attachment against lessee of a biotech manufacturing facility.
  • Successfully defended shareholder derivative claim brought by founder against one of nation's largest owners and developers of multifamily property.  Negotiated a "walk away" settlement in which clients paid nothing and obtained dismissal with prejudice of all claims against them.
  • Acted as lead counsel in a two-month bench trial resulting in decision rejecting implied contract claims that would have precluded development of a master-planned residential community with a build out value in the hundreds of millions of dollars.
  • Obtained dismissal of a multimillion dollar defamation claim against the largest radio broadcaster in the United States.
